Child Abduction & Child Arrangements

We can determine if the case can be prepared and filed as a Hague Convention application.    The Hague Convention is a treaty initially formed to assist in international child arrangement disputes. Under this treaty, abducted children can be returned to their country of origin.  The treaty also ensures that child supervision rights and agreements are adequately enforced in foreign countries.   However, not all countries have signed the Hague Convention, and even those who have signed do not always consistently adhere to the conditions.  Robertsons Family Law can help you to address and resolve these issues.

We can help you retain a local solicitor in a foreign jurisdiction and assist in preparing the necessary testimony and affidavits needed for a Hague Convention application.  (Should the abduction be to a country not part of the Hague Convention, we shall advise on alternative solutions and strategies).

FAQs on International Family Law

I live in England, but my child’s parent is in the United States.   Can I claim financial support across jurisdictions?

Yes, you are entitled to seek an order for periodical payments or a lump sum for a specific need from a parent aboard.  The order will be enforced in the country of residence, therefore the US.  Speak to us at Robertsons Family Law.  We can help transmit your claim to the US and get the appropriate orders against the other parent.

I come from another country.   Can I legally divorce in England and Wales?

Yes, divorce is possible in another country other than your country of origin. However, one of the married couple must demonstrate that they live in the UK.

What about child support issues across borders?

The international rules of the Hague Convention may apply.  Our family law solicitors at Robertsons Family Law will first determine in which country the child is in ‘habitual residence’, and we can (through the Hague Convention as a legal vehicle) enforce the country of origin’s laws.

We divorced aboard, but I now live in the United Kingdom. Am I stuck with the terms of the divorce order?

If we are talking about UK-based assets, you may need a new order from an English court.   It might not be straightforward as there should be a treaty between the UK and the country you are from.  Also, the English court must be satisfied with your connection with the UK, which might be tricky to prove.   

It is also essential to have your divorce legally recognised in the UK, should you want to get married again.   Robertsons Family Law will be happy to help.
